Current rate in effect since January 1, 2010; next statewide change: the rate stays at $7.25: K.S.A. 44-1203 sets no later step.
Tipped workers
An employer may count tips toward the Kansas minimum wage if tips have customarily been part of the employee's pay and the employee actually received and kept them. The employer must still pay at least $2.13 an hour, and if wages plus tips fall short of $7.25 the employer pays the difference.
Minors, trainees and other rates
K.S.A. 44-1203 sets one rate and no separate youth or training rate. The section does not apply to employers and employees covered by the federal law, where the federal $4.25 an hour wage for workers under 20 in their first 90 consecutive calendar days is available.
Local minimum wages in Kansas
Kansas does not let local governments set a higher wage: no city, county or local government unit may enact or administer a law that requires an employer to pay wages at any rate higher than the minimum wage, unless state or federal law requires it (K.S.A. 12-16,130).
How the Kansas minimum wage is set
Kansas does not index its rate: K.S.A. 44-1203 fixes the minimum wage at $7.25 an hour on and after January 1, 2010, up from $2.65 before then, and the Legislature would have to amend the section to change it.
